Bpro, Outlaws in contractual dispute

Bpro Gaming and Outlaws, two of Bulgaria’s biggest esports organisations, could soon be involved in a legal battle regarding the contracts of Nikolay "niki1" Pantaleev and Nikola "NK4Y" Radushev.

The issue was first brought up by Bpro co-founder Dimitar Slavkov‏ on April 3, when he suggested on Twitter that Outlaws were being "sneaky" in their pursuit of two of the team’s players.

Since the start of the month, Nikolay "⁠niki1⁠" Pantaleev and Nikola "⁠NK4Y⁠" Radushev have been playing for both Bpro and Outlaws in different competitions, leaving fans confused as the two organisations have remained silent on the topic. Both players have been part of Bpro since January 2016 with the exception of a brief period at the start of this year in which niki1 represented MK before the team disbanded.

The chaotic situation saw niki1 and NK4Y take on (and defeat) Bpro earlier in the week, in a Hellcase Cup qualifier match. Days earlier, the pair had helped Outlaws to secure a spot in the closed qualifier for ESL One Cologne, in which Bpro were eliminated in the Round of 32.

"The two players are playing for the team of another organization without our permission, which is against the commitments outlined in their contracts,” Bpro said in a statement given to HLTV.org.

"We raised the issue publicly on April 3, and a meeting was arranged with UltraPlay [the company behind Outlaws]. We did not reach an agreement.

"The situation was very bad for us because the players would not even show up for our matches, which had to be cancelled or moved if possible. Later on, we agreed with the two players that they would show up for some of the matches, at least for the time being.

"While this was happening, Outlaws benched Acl and Partodis, and continued to field our players, signing them up for multiple tournaments, including the ESL Southeastern Championship, the ESL One Cologne Open Qualifier, the Hellcase qualifier and the Balkan Pro League.

"So far, negotiations have been fruitless. The only thing Outlaws have asked us is to not make too much noise about this, but it is difficult not to."

Contacted by HLTV.org, the two players in question claimed that they are no longer tied to Bpro after submitting resignation letters with a two-week notice earlier in the month, explaining that, under Bulgarian law, that is standard procedure for service provider agreements like the ones that tied them to the organization.

"I cancelled my contract with Bpro at the beginning of April as per the contractual terms and resignation period, and I am currently playing as a free agent without an organization," niki1 told HLTV.org.

"I am in negotiations with Outlaws to join their organization, but have not signed any contract yet."

Bpro confirmed that they have received the duo’s resignation letters but claimed that the documents are not legally acceptable. They are now ready to take the case to court to defend their position and keep the players in their ranks.

"As an organization, we have invested a lot of resources in these players and thus they have grown to become valuable players,” Bpro added.

"Additionally, to support the team we have provided the players with high-spec gaming equipment and attended to their requests as they were raised. To this day, the two players are still using this equipment while playing for Outlaws.

"Bpro has followed the commitments outlined in the contracts in terms of payment, the last of which came through in April 2017. With great disappointment and reluctance, we intend to take legal action against the two players and against the organization Ultra Play/Outlaws."

HLTV.org knows that tournament organisers will refrain from getting involved in a matter of this nature at this point and will wait for the two organisations to reach an agreement or for the Bulgarian justice to make a ruling.

As for Outlaws, they remain confident that the players are no longer contracted to Bpro, even though they have yet to tie them down to contracts.

"Outlaws respect and work according to the professional ethics and standards of the global esports industry,” the organization told HLTV.org.

"Rumors and unfair game cannot be tolerated and are subject of legal actions by Outlaws and the organizations supporting the team.

"Any allegations without concrete facts are working against the professional eSports ecosystem in general, and moreover the teams that are playing so hard to make the difference and are trying to fulfill their dreams."

I cancelled my contract with Bpro at the beginning of April as per the contractual terms and resignation period i have no info on the matter but it seems like bpro had some legal loophole as every contract has terms of discontinue written in it and if the players tried to follow what is written and are taken to court, something must be wrong. nvm FrenZy_Berserk explained lower in further detail. Our country has the same 1 month period after the resignation letter so it seems logical

I don't wonder, it is csgo scene... In CS 1.6 you could make a deal by handshake but csgo they betraying everyone. Make a good offer with salary on paper and players cannot refuse it, either will be playing on a serious level like G2 and the other teams.

Yeah, right. There was a LOT of backstabbing and unprofessionalism in the 1.6 scene. I specifically remember, when 4 players of coL went to EG behind, well, everyone's back.

Because muricans and EG was very professional back then. But I remember AdreN (from Gambit) replacing LeX (old Virtuspro) in a tournament where both participated. Adren's team (I think k23) didn't make the playoffs while VP did. In a BO3 against some other team LeX didnt't feel well and was replaced by AdreN during an ongoing match. No one complained about contracts / playing for another team. Afair he even carried VP so hard that they won the tournament. So this Russian guy is kinda right. EG was just an exception.

I don't know anything besides what this article said, but it honestly seems like Bpro gave these guys the chance to get experience on a pro level, even provided them the gear, and then the players jumped on the first chance to upgrade. They probably they nothing contractually wrong, but I would have a really bad taste in my mouth if that was me. EDIT well, it seems like what they said about Bulgarian contract law was misinformed, so IMO they seem both contractually and morally wrong.

It's not a bad organization, and neither are they trying to take advantage of their players. Both niki1 and nk4y have signed contracts with the org, which means they are getting paid and are obligated to play FOR the team (they are also using gear given to them by Bpro). They claimed they filed a resignation letter and under Bulgarian law it's allowed for them to quit instantly, which is a false statement. After filing the letter you are still obligated to work (or play) for the organization for another month, or to pay them for quitting early, they've done neither. It's in BPro's full right to file a law suit, so don't trash talk when you don't understand the details.

After filing the letter you are still obligated to work (or play) for the organization for another month Depends of the contract. The period can be instantly from the side of the company and 1 month from the side of the worker. However after some time it can be equal for both, we don't know what are their lines in the contract. But most used is 1 month for both sides.

It doesn't look good for Bpro, the issue was only brought up after they lost to Outlaws. This feels like a revenge plot for Bpro Co-Founder Dimitar Slavkov. After his team lost to "former" Bpro players he used his last life line to call foul play. His tweet on April 26th, to the tournament organizers highlights the fact that NK4Y and niki1 are allegedly contracted. On April 22nd he retweeted a tweet from his player, psycho, telling several players, including niki1 and NK4Y that he would see them at the closed qualifier.

tl;dr niki1 and nkay had a contract with BPro, then two week contract notice, both of them have told that they left the org (BPro) and made a resignation letter for that, and now a free agent, bringing their BPro's facility (gaming's equipment) to another org which they have yet to sign a contract. Feeling betrayed, BPro denied the letter, because it is not acceptable to left the org while you're in a contract. They are currently going to lawsuit to clear this up. CMIIW, but this case is very interesting.

I heard about this on 3rd of April and everyone in Bulgaria knew about it after being featured on GplayTV. This issue has been going on for a long time. I think Bpro is raising awareness now because no solution has been found so far.

Do not forget that niki1 has already done the same thing before. He once left Bpro to make a MK team with spyleader and after 1 month he came back signing new contract. Also the following players did not inform their org about their plans of making new team with Outlaws. If they did so they would not have any problems now.

They are kinda right to be honest. If they actually have signed contracts with the org, they should not be playing for another organisation without their permission. In that terms this is kinda childish and stupid thing to do. Probably it wouldn't harm the bpro org in any way, but that's how it works. Same goes in every other sport... and yes, i'm comparing it to the real sports, because it is basically a sport... even tho it's "esport".

I don't even know why Bpro are even wasting their time with this. Its obvious that Niki and Nk4y dont want to play for their team and even if they win the court case and MAKE then compete for Bpro I can't imagine that they'll be very cooperative and motivated to do so.
